upTownArt
Terms for orders and artist accounts in the independent upTownArt online store.
upTownArt is the seller and contract partner of the customer. The operator is Michael König-Weichhardt, trading as upTownArt, Sporgasse 24, 8010 Graz, Austria. Product displays are invitations to place an order. A contract is formed when we confirm the order or accept payment.
Prices are shown in euros and include applicable charges where stated. Shipping is shown separately before payment. Payment uses methods offered by Stripe.
Originals and limited editions may be unique. If an unavoidable double sale occurs, we will promptly refund the payment.
Goods remain ours until fully paid. Purchasing an artwork does not transfer copyright or reproduction rights.
Artwork plans apply only to artworks: 20 slots for 39 euros per month with 15 percent commission, or 50 slots for 79 euros per month with 12 percent commission. Handcraft plans apply only to independently made handcraft priced at no more than 200 euros per variant: 20 slots for 9 euros per month with 10 percent commission, or 50 slots for 19 euros per month with 8 percent commission.
Combined plans include either 20 artworks and 20 handcraft products for 45 euros per month or 50 artworks and 50 handcraft products for 89 euros per month. Category commission rates remain 15 or 12 percent for artworks and 10 or 8 percent for handcraft. Annual billing is 20 percent cheaper than twelve monthly payments.
Plans with 20 slots allow up to three collections, plans with 50 slots up to six, Combined 20/20 up to six and Combined 50/50 up to twelve collections. Exhibition works do not consume a plan slot while included in an active separately paid upTownArt exhibition; after the exhibition they count again or are temporarily deactivated if the limit is exceeded.
Price negotiation is an optional per-variant feature for Artwork 50 and Combined 50/50 plans and is available only from 100 euros. Buyer offers may be no more than 20 percent below the regular price; artists may accept, decline or make a different counteroffer. Handcraft 50 and Combined 50/50 plans may instead enable custom-order enquiries per variant.
Commission applies only to the product price. Shipping is paid by the customer and passed in full to the fulfilling artist side; it carries no commission. The plan and commission rate are frozen per order line. After confirmed payment, settlement for the artist side is initiated. Following a refund or payment dispute, the corresponding payout amount may be cancelled, offset or reversed through Stripe.
Artists fulfil orders directly or through their expressly designated supplier; upTownArt does not operate a central warehouse. upTownArt remains the seller, the customer's contract partner and the central contact for statutory claims. Artists must follow the selected shipping method, pack safely and provide a valid tracking number for shipped orders.
Artists may assign individual products, variants, collections or their entire catalogue to an external supplier. After confirmed payment, only affected order lines and fulfilment data are shared. Artists are responsible for ensuring suppliers process data securely, solely for fulfilment and on time.
