Terms and conditions

Seller, marketplace and contract

The artist is the seller and contract partner of the customer for each work offered under their name. The marketplace operator is Michael König-Weichhardt, trading as upTownArt, Sporgasse 24, 8010 Graz, Austria. upTownArt intermediates the listings and provides the technical ordering and payment connection. In the combined cart, Stripe processes one combined payment for the complete order through the upTownArt platform Stripe account. Purchases from multiple artists retain separate purchase contracts. In a separate seller checkout, where offered, Stripe processes a direct payment in the relevant seller's connected Stripe account. Product displays are invitations to place an order; each purchase contract is formed when the order confirmation is sent for the relevant seller.

Prices, payment and invoice

Prices are shown in euros and include applicable charges where stated. Shipping is shown separately before payment. The combined cart payment uses the payment methods offered in Stripe Checkout and is processed in the upTownArt platform Stripe account. Each artist's share and the agreed commission are accounted for separately. In a separate seller checkout, payment goes directly to the connected seller account, where Stripe deducts the agreed upTownArt commission as an application fee. The payment confirmation is not the seller's tax invoice; each seller issues any invoice required by law.

Availability

Originals and limited editions may be unique. If an unavoidable double sale prevents the relevant seller from fulfilling the contract, upTownArt supports the technical refund of the affected payment to the original payment method.

Ownership and copyright

Goods remain the property of the relevant seller until fully paid. Purchasing an artwork does not transfer copyright or reproduction rights.

Artist plans and settlement

Artwork plans apply only to artworks: 20 slots for 39 euros per month with 15 percent commission, or 50 slots for 79 euros per month with 12 percent commission. Handcraft plans apply only to independently made handcraft priced at no more than 200 euros per variant: 20 slots for 9 euros per month with 10 percent commission, or 50 slots for 19 euros per month with 8 percent commission.

Combined plans include either 20 artworks and 20 handcraft products for 45 euros per month or 50 artworks and 50 handcraft products for 89 euros per month. Category commission rates remain 15 or 12 percent for artworks and 10 or 8 percent for handcraft. Annual billing is 20 percent cheaper than twelve monthly payments.

Plans with 20 slots allow up to three collections, plans with 50 slots up to six, Combined 20/20 up to six and Combined 50/50 up to twelve collections. Exhibition works do not consume a plan slot while included in an active separately paid upTownArt exhibition; after the exhibition they count again or are temporarily deactivated if the limit is exceeded.

Price negotiation is an optional per-variant feature for Artwork 50 and Combined 50/50 plans and is available only from 100 euros. Buyer offers may be no more than 20 percent below the regular price; artists may accept, decline or make a different counteroffer. Handcraft 50 and Combined 50/50 plans may instead enable custom-order enquiries per variant.

Commission is calculated cent-exact per order line and only on the product price. Customer-paid shipping is allocated to the fulfilling artist and remains entirely commission-free. Plan, category and commission rate are frozen per order line. For the combined cart payment, the agreed commission is deducted in the artist settlement.

Only after documented fulfilment is the remaining amount transferred to the connected Stripe account when the connection is eligible; pending refunds, payment disputes or account restrictions may delay the transfer. The subsequent payment to the bank account depends on the Stripe payout schedule and account status.

For direct seller payments, Stripe deducts the agreed upTownArt commission as an application fee. Stripe payment, payout, currency-conversion or dispute fees are not upTownArt commission.

Refunds use the original payment method; central payments are processed in the platform account and direct seller payments in the relevant seller account.

Shipping and commissioned fulfilment

The seller fulfils the order directly or through a production or fulfilment service commissioned directly by them; upTownArt operates no central warehouse and does not thereby become the seller or contract partner. The seller must comply with the offered shipping method, ensure safe packaging, and provide a valid tracking number for shipped orders.

Shipping within the seller's country of establishment is automatically active at the interface layer and requires no international product or variant toggle. Any seller and home-country evidence required by law is reviewed once at account level, not per product or variant; general domestic seller obligations remain. For other countries, the seller may enable international shipping per product and variant and commission, for example, a print-on-demand provider, merch-store provider, printing service, local producer, or fulfilment service. The seller selects and commissions the service, retains their records, and remains responsible for seller, product, data-protection, packaging, customs, and shipping duties. Commissioning the service, or the service's own registration, does not automatically transfer the seller's statutory duties. Legally required seller and destination evidence for other countries remains unaffected. Paid orders must not be disguised as gifts or private shipments.

The PPWR generally applies from 12 August 2026. Automatic home-country shipping concerns only the shipping toggle; an international toggle is likewise not regulatory or legal approval. Registration, system-participation, authorised-representative, and other seller duties remain.
